Terms of Use

These Terms of Use ("Terms") govern your use of connxct.club, CTC TV on the web and on Roku, CTC Radio, CTC Magazine, our newsletters, and every other website, app, channel, and service operated by Connect the Coast ("CTC", "we", "us") that links to these Terms (together, the "Services").

By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. PLEASE READ SECTION 13: IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS.

1. Eligibility

You must be at least 13 years old to use the Services, and at least 18 (or the age of majority where you live) to buy a membership, make a purchase, or submit content. Some programming contains explicit language and mature themes; viewer discretion is advised.

2. Memberships and purchases

Memberships, including CTC TV, and merchandise are sold and billed by our commerce provider, Fourthwall, under its own terms and privacy policy, which apply to your purchase. CTC does not receive or store your full payment card details.

Memberships renew automatically at the then-current price until you cancel. You can cancel through your Fourthwall account; cancellation stops future renewals, and access continues until the end of the period you paid for. Except where the law requires otherwise, payments are non-refundable and there are no refunds or credits for partial periods, unused time, or programming you did not watch.

A membership gives you a personal, non-transferable right to access member features while it is active. Access on the website is tied to the email used at checkout; do not share it. What is included in a membership, and its price, may change; we will give reasonable notice of price changes before they apply to your next renewal.

3. CTC TV programming

CTC TV is a scheduled channel. "Live" means the programming plays on a shared schedule; it is not a live broadcast of events as they happen unless we say so. Programming, schedules, the Coming Up guide, weather, events, and other information shown on the Services may change, be delayed, or contain errors, and are provided for general information only. Weather and event listings come from third parties; do not rely on them for safety, travel, or purchasing decisions.

4. Your license to use the Services

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Services for your personal, non-commercial use. All content on the Services, including videos, music, articles, charts, designs, logos, and software, is owned by CTC or its licensors and protected by law. Everything not expressly granted is reserved.

5. What you may not do

You agree not to:

  • download, record, capture, rip, re-stream, rebroadcast, or redistribute any programming or content, or access streams or files other than through the players we provide;
  • get around, disable, or interfere with the membership gate, access controls, or any security feature, or share member access with others;
  • scrape, crawl, or harvest the Services or data from them by automated means, or use the Services to train machine-learning or AI models, without our written permission;
  • use the Services for anything unlawful, infringing, harassing, or fraudulent, or to send spam or malware;
  • impersonate anyone, or misrepresent your connection with any person or with CTC; or
  • interfere with the operation of the Services, or reverse engineer them except where the law expressly allows it.

6. Content you send us

Music videos, podcasts, and other media you submit for broadcast are governed by the Creator Submission Agreement you sign when submitting. For anything else you send or post (for example comments, guestbook entries, event submissions, feedback, and messages), you grant CTC a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, edit, publish, and display it in connection with the Services and the CTC Network, and you confirm you have the right to grant it. We may remove anything at any time. Feedback and ideas you give us may be used without obligation to you.

7. Copyright complaints

If you believe material on the Services infringes your copyright, send a notice to connectthecoast@gmail.com with the subject "Copyright notice" that includes: your physical or electronic signature; identification of the work; identification of the material and where it appears on the Services; your contact information; a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner. We may remove material and terminate repeat infringers.

8. Third-party services and links

The Services rely on and link to third parties, including Fourthwall, Roku, Bunny, Beehiiv, YouTube, Instagram, and event and weather providers. We do not control them and are not responsible for their content, availability, policies, or practices. Your use of them is at your own risk and under their terms.

9. Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, CTC DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. Content submitted by artists, creators, and other third parties reflects their views, not CTC's, and CTC is not responsible for it.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CTC AND ITS OWNERS, OPERATORS, AFFILIATES, PARTNERS, AND PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID CTC IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow some of these limits, so they may not all apply to you.

11. Indemnification

You will defend, indemnify, and hold harmless CTC and its owners, operators, affiliates, partners, and personnel from any claim, loss, liability, damage, cost, and expense (including reasonable attorneys' fees) arising out of your use of the Services, anything you submit, or your breach of these Terms or of law.

12. Suspension and termination

We may suspend or end your access to any part of the Services at any time, with or without notice, including for a breach of these Terms. We may change, suspend, or discontinue any part of the Services at any time. Sections 4 through 16 survive termination.

13. Dispute resolution: arbitration and class action waiver

Informal first. Before starting arbitration, you agree to email connectthecoast@gmail.com with a description of the dispute and give us 60 days to try to resolve it.

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to the Services, these Terms, or any agreement that incorporates them (including the Creator Submission Agreement) will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court, and either party may seek an injunction in court to protect its intellectual property. The arbitration will take place in San Luis Obispo County, California, or remotely, and judgment on the award may be entered in any court with jurisdiction.

Class action and jury waiver. YOU AND CTC EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION. The arbitrator may award relief only to the individual party seeking it. If this waiver is found unenforceable for a claim, that claim must be decided in court, and the rest of this section still applies to all other claims.

Opting out. You may opt out of this arbitration agreement by emailing connectthecoast@gmail.com within 30 days of first accepting these Terms, with your name, email, and a clear statement that you opt out of arbitration.

Time limit. Any claim must be brought within one year after it arises, or it is permanently barred, to the extent the law allows.

14. Governing law and venue

These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 13, the state and federal courts located in San Luis Obispo County, California have exclusive jurisdiction, and you consent to them.

15. Changes to these Terms

We may update these Terms. The new version applies from its effective date, shown at the top. Continuing to use the Services after that means you accept it. Changes to Section 13 will not apply to a dispute we already know about before the change.

16. General

These Terms, the Privacy Policy, and any agreement that incorporates them are the entire agreement between you and CTC about the Services. If any part is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. We are not liable for delays or failures caused by events beyond our reasonable control.
